Inherent Risk
As with all adventure activities, including hill walking, archery and paddlesports, there is an inherent risk associated. Whilst North Skye Outdoors and its instructors/ guides ensures a high professional standard of instruction, care and safety, all our clients must be aware that participation in any activity involves an acceptance of risk, and responsibility for one's own actions, and the actions of any whom they are the legal guardian.
Due to the changeable nature of the environment in which these activities take place, no specific element of an advertised service can be guaranteed absolutely such as preferred locations or routes.
Any members of North Skye Outdoors activity sessions who act in contravention of the decisions or advice of their guide/ instructor, or else undertake independent or unadvised actions during the activity session forfeit all professional protection and duty of care from the guide/ instructor.
Participants under the age of 18 years must be accompanied by their parent or legal guardian at all times, unless written permission has been given by such parent/ legal guardian for the child to partake on an activity without them.
Clients should be physically fit and healthy for the activities they have chosen, if uncertain, they should contact North Skye Outdoors and discuss options, or seek professional medical advice.
Clients should fall within the described weight restrictions for any chosen activity. These are found on each paddlesports activity page; there is no weight restriction for hill walking or archery.
All participants are required to complete and return a Medical and Risk Acknowledgement Form prior to the activity, which will be sent alongside your booking confirmation.
Cancellations
Whilst every attempt is made to ensure that advertised courses/activities run, sometimes cancellations are necessary due to dangerous or unsuitable weather conditions, or unforeseen factors. When these conditions occur, North Skye Outdoors will notify the customer as soon as practical, and will always attempt to reschedule, offer an alternative activity where possible, or offer a full refund.
Cancellation insurance cover is recommended to all clients.
Refund Policy
If a booking is cancelled by the client less than 7 days before the start of the activity, there is a 20% cancellation fee and an 80% refund is guaranteed.
In the event of later cancellation by the client (72 hours or less before the activity start) no refunds can be made.
If clients arrive late to the activity, North Skye Outdoors will attempt to accommodate this, or reschedule, but it is not always possible. Clients will not be eligible for a refund if they arrive late and are hence unable to participate in an activity.
North Skye Outdoors and any of their guides, instructors and leaders reserve the right to exclude any member from participation on planned activities if they might endanger the success or safety of the rest of the party through lack of fitness, ill-health or dangerous technique, or are believed to be under the influence of drugs or alcohol. No refunds will be administered in this situation.
For General/ Family's sessions there is a minimum of 3 total participants required. If this minimum number is not met, North Skye Outdoors reserves the right to offer a rescheduled date or time, if possible, or to refund the amount in full.
Please note that North Skye Outdoors are unable to refund any associated costs, such as accommodation, transport or food costs.
Booking Amendments
Clients are responsible for informing North Skye Outdoors of any changes to their booking prior to the activity start, for example, extra people participating. Payment may be required corresponding to the change.
Bookings are secured only when payment has been received in full. After such time the date(s) shall be considered booked. If no fee has been received then there is no guarantee that the activity can still be offered on the dates chosen. This applies to all bookings.
Data Protection
North Skye Outdoors collects personal information to ensure the highest possible safety and wellbeing for all individuals, to best suit preparation and activities for all participants which may include communicating with participants, and to enter into a contract with participants to provide products and services.
Personal data may be used for marketing purposes, only when permitted by law and with permission from the participant.
North Skye Outdoors will not share any personal information with anyone, unless to medical professionals in the event that treatment is required.
All personal information is stored securely online, and is stored for the minimum required timeframe.
If an individual wishes to know the personal information stored about them, or to request it to be deleted, restricted or rectified, they should contact North Skye Outdoors directly via email.
Liability
North Skye Outdoors has all required insurance, including Employers, Public and Products Liability, and Professional Indemnity insurance.
Clients accept that North Skye Outdoors and their instructors/ guides are not under any liability whatsoever in respect of loss or damage to personal property, not caused by the negligence or default of North Skye Outdoors whilst attending an activity.
North Skye Outdoors accept no liability for the consequences of strikes, riots, acts of war or terrorism, disease outbreaks, government intervention, natural disasters or adverse weather conditions. If such occurrences cause North Skye Outdoors to cancel an activity, we will offer an alternative if possible.
